You will find below my recent article in SuperyachtNews analysing the implications of Spain’s Golden Visa regime for non-EU yacht owners seeking to benefit from the Temporary Admission (TA) customs and tax regime. The article examines a recent case in which the Spanish customs authorities in Palma denied TA regime to a UK resident and yacht owner solely because he held a Spanish Golden Visa, despite his tax residence, establishment and centre of interests is 100% in the UK. It also highlights the broader legal uncertainty that this interpretation could create for thousands of non-EU yacht owners holding residence permits issued by EU Member States (as the user under TA must be non-EU resident), underlining the need for a consistent and harmonised application of the Union Customs Code across Europe.
